In Texas, a charge of Prostitution is taken very seriously. Section 43.02 of the Texas Penal Code defines Prostitution as knowingly offering to engage, agreeing to engage, or engaging in sexual conduct for money and “solicitation” would be defined as to knowingly solicit or attempt to recruit, in a public place, another person to engage in an act of prostitution.
Convictions of a prostitution or solicitation of prostitution charge are punished the following ways:
First Time Offender: Class B Misdemeanor, which is punishable by up to 180 days in jail and a fine of up to $2,000. Registration as a sex offender with the State of Texas can also be ordered by the judge with this type of case.
Second or Third Time Offender: Class A Misdemeanor, which is punishable by up to 1 year in jail and a fine of up to $4,000. Registration as a sex offender with the State of Texas can also be ordered by the judge if the offender has not already had to register.
Fourth or More Time Offender: State Jail Felony, which is punishable from 180 days to 2 years incarceration in a State jail facility and a fine of up to $10,000. Registration as a sex offender with the State of Texas can also be ordered by the judge if the offender has not already had to register.
