Houston Assault Defense Attorney
The Texas Criminal Code defines a misdemeanor assault as: a person commits at least misdemeanor assault he or she either (a) intentionally, knowingly, or recklessly cause bodily injury to another, (b) intentionally or knowingly threatens another with imminent bodily injury, or (c) intentionally or knowingly cause physical contact with another when the person knows or should reasonably believe that the other will regard the contact as offensive or provocative.
Assault is typically classified as a Class A Misdemeanor, which carries a penalty of up to a year in jail and a $4,000 fine. An assault conviction can lead to problems with employment, as many employers fear what this charge could mean for their workplace environment.
Assault cases are an interesting breed because they present many issues for the prosecution that knowledgeable defense attorneys can attack. The police often show up after the alleged incident occurred. Unless it was recorded, it becomes a he said, she said type of case. Many times, the wrong person is arrested. A knowledgeable and aggressive attorney will attack the weaknesses in the State’s case.
